13-Year-Old Florida Girl Sues Instagram and School After Wrongful Arrest

After spending 11 days in juvenile detention for something she was wrongly accused of, 13-year-old Florida girl Nia Whims and her family are now suing Instagram and Nia's former school.

Nia was framed by her 12-year-old classmates who were impersonating her on the social media platform, Instagram, where they made threats against the school, saying they were going to do things like "blow up the school and kill people."

Nia was arrested, spent 11 days in a juvenile detention center & and charged with second-degree felony "for making a written threat to do bodily harm or commit an act of terrorism." It wasn't until after this that police were able to track IP addresses and find the 12-year-old girl, who was impersonating Nia the entire time.

On Feb. 10, Pembroke Pines police announced Whims was acquitted on all charges, and the 12-year-old impersonater was arrested and charged with several offenses.

According to WFLA News Channel 8, The lawsuit, filed by Whims' mother, Lezlie-Ann Davis, says a 12-year-old student told Pembroke Pines police Whims sent the messages to her. When questioned by officers, Whims said she and the 12-year-old, called "M.S." in the lawsuit, messaged on Instagram, but no threats were ever made.

The lawsuit accuses Instagram of not doing enough to flag fake accounts and not "promptly" aiding the investigation with data that would have proven Whims' innocence. It also claims that Whims was bullied at her school for months, and nothing was done.

The family is seeking an excess amount of $30,000 in damages.
